PRIVACY NOTICE

 

GRUPO KORDILA SA DE CV (THE PROVIDER), located at VIALIDAD DE LA BARRANCA 6 S 400 NA TORRE 1 P 4 B, INTERLOMAS, HUIXQUILUCAN, MEXICO, ZIP CODE 52787, is responsible for the use and protection of your personal data, whether collected directly or transferred to us by third parties. Your data is safeguarded in accordance with applicable personal data protection legislation in possession of private individuals.

 

The personal data we collect directly from you or receive from third parties with whom we have agreements will be used for the following purposes, which are necessary to provide the services we offer:

 

  • To provide personalized services in graphic design, web design, digital marketing, and, when applicable, technical support and/or training (hereinafter “our services”).

  • To establish contact via phone and/or electronic means, including email, SMS, and WhatsApp, to provide more information about our services or any other activity requiring direct communication with the service requester.

  • For commercial prospecting.

 

Additionally, we inform you that the data collected by THE PROVIDER, in accordance with this Privacy Notice and based on Article 12 of the Federal Law on Protection of Personal Data Held by Private Parties (“Data Law”), may be used for purposes that are compatible or analogous to those previously mentioned without the need for renewed consent—unless you expressly object.

 

We also use your personal information for the following secondary purposes, which are not necessary to provide our services but allow us to offer better care:

 

  • Marketing and advertising.

  • To follow up on our business relationship and request feedback to assess satisfaction with our services.

 

Refusal to use your data for these secondary purposes will not, under any circumstance, be grounds to deny you our services.

 

To fulfill the purposes outlined in this privacy notice, we may collect the following personal data:

 

Identification: name, address, phone numbers, email, signature, photo, gender, marital status, place and date of birth, nationality, skin, eye, and hair color, distinguishing marks, height, weight, body type, blood type, CURP (Unique Population Registry Code), social security number, and any information contained in official ID documents.

 

Family: names of parents; spouse and children’s data such as name, gender, place and date of birth, marital status, and information from marriage certificates or similar documents. (By providing third-party data, you declare you have their consent.)

 

Financial: Federal Taxpayer Registry (RFC) and banking details when payment is made for services and an invoice is requested.

 

Academic and Employment: educational background, academic and non-academic records, education level, and information found in degrees, certificates, professional licenses, and work history.

 

Financial (continued): RFC, bank account info, and any data related to financial situation.

 

Please note: if THE PROVIDER requires financial data as listed in section 5 above, and based on Articles 3(VI), 8, and 15–18 of the corresponding regulations of the “Data Law,” your continued use of our services and lack of verbal or written objection constitutes your express consent for its use.

 

Additionally, THE PROVIDER is exempt from requesting renewed consent for the use of data described in section 5 when the situations outlined in Articles 10 and 37 of the “Data Law” apply.

 

Personal data provided or received for implementing our services (including that collected by third parties with whom we have contracts) will not be disclosed, distributed, or sold. It may only be shared with government entities THE PROVIDER is legally obligated to report to, or with private individuals or entities with whom we maintain or will maintain contractual relationships—under confidentiality and data protection agreements and as outlined by the “Data Law” and applicable regulations in Mexico.

 

Thus, your data may be shared with entities related to THE PROVIDER to evaluate our services in the Mexican market, with government entities, and with private individuals or organizations with which we have signed service and/or work contracts.

 

By reading this Privacy Notice, you consent to THE PROVIDER collecting and using your personal data for the purposes outlined in this document, as well as transferring your data under the terms specified and for any similar or compatible purposes under applicable law.

 

ARCO RIGHTS

 

You have the right to know what personal data we hold about you, what we use it for, and how we use it (Access). You also have the right to request corrections if your information is outdated, inaccurate, or incomplete (Rectification); to have your data deleted from our records or databases if it is not being used as per the principles, duties, and obligations of the law (Cancellation); and to oppose the use of your data for specific purposes (Opposition). These are known as ARCO rights.

 

To exercise any ARCO rights, you must submit a written request to THE PROVIDER at the following address:

We will process your request and respond to any questions regarding how your information is handled.

 

Your request must include:

 

  • Your name, address, and email to send the response.

  • A valid ID (official document with photo and signature).

  • A signed power of attorney with two witnesses (and copies of their IDs) if submitted by a legal representative.

  • A clear description of the ARCO rights you wish to exercise (e.g., limit use, access, revoke consent).

  • A clear list of the data you want to act upon.

  • Any other documents that help locate your personal data.

 

If you’re requesting a correction, please also include the proposed corrections and supporting documentation.

 

If you’re revoking your consent, state this clearly and ask for your data to no longer be used.

 

THE PROVIDER will respond in writing to your provided address or email within 20 (twenty) days of receiving your complete request. If appropriate, the change will take effect within 15 (fifteen) days after notification.

 

You may revoke your consent to process your personal data. However, not all requests can be fulfilled immediately, especially if there’s a legal obligation to keep processing your data. Note that revoking your consent may mean we can no longer provide the requested service or continue our relationship.

 

To revoke consent, submit a request to THE PROVIDER’s address directed to the Privacy Department, following the same procedure outlined for exercising ARCO rights.

 

CHANGES TO THIS PRIVACY NOTICE

 

This Privacy Notice may change due to legal updates, business needs, changes in our services or model, or privacy practices.
